Purpose<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms and Conditions of Sale, hereinafter referred to as the \u201cTCS\u201d, govern all services provided by NEWDEAL INSTITUT (N.D.I.), the company that publishes and operates the online revision platform accessible via klf-examen.fr, hereinafter referred to as the \u201cPlatform\u201d, to any individual wishing to purchase access to one or more preparation modules, hereinafter referred to as the \u201cClient\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The TCS apply to any order placed on the website klf-examen.fr, in particular for the purchase of access to digital content (French Civic Exam and, in the future, TCF, DELF\/DALF, TEF, etc.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. Offer and description of services<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Platform offers online preparation modules, hereinafter referred to as the \u201cModules\u201d, accessible via a personal account, including in particular, depending on the Module:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">topic-based quizzes aligned with the format of the tests;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">sessions under exam conditions (e.g. French Civic Exam: 40 questions, up to 45 minutes, with the possibility to pause during practice sessions);<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a question database (e.g. French Civic Exam: 500+ questions);<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">progress statistics and a history of practice sessions;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">access optimised for computer, tablet and mobile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The detailed and up-to-date description of each Module is presented on the corresponding order page on klf-examen.fr and shall prevail in the event of a minor contradiction with these TCS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Important: the Platform is a training tool and does not constitute either an official exam or a guarantee of success.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Order and acceptance of the TCS<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Validation of the order implies full and complete acceptance of these TCS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client declares that they:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">are of legal age and have the legal capacity to enter into the contract;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">provide accurate and up-to-date information, in particular the email address required to create the Account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Prices and payment terms<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are indicated in euros, including VAT, at the time of ordering.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">French Civic Exam, Premium Access (offer currently in force, unless otherwise stated on the website):<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u20ac49 including VAT<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3 months of unlimited access<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">one-off payment, with no automatic renewal (renewable through a new purchase)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payment is made online, securely, by bank card via Stripe (or any other payment method offered on the website). Payment is due immediately when the order is placed. An invoice is sent by email.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. Access to the service, activation and duration<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Access to the Platform is opened after payment has been validated. The Client receives their login details by email, generally within 5 to 15 minutes (processing time).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The access period indicated at the time of purchase (e.g. 3 months) starts on the purchase date, namely the date on which payment is validated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client undertakes to keep their login details confidential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. User account, individual licence and prohibition of sharing<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Unless otherwise stated, access is granted:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">for 1 user;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">on a personal and non-transferable basis;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">and linked to the email address provided at the time of purchase.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Account sharing and any distribution of content (copying, resale, making available to third parties) are strictly prohibited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of non-compliance, Newdeal Institut reserves the right to suspend or terminate access, without refund in the event of a proven breach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>8. Right of withdrawal<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with Articles L221-18 et seq. of the French Consumer Code, the Client has a period of fourteen (14) days to exercise their right of withdrawal from the conclusion of the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal may not be exercised for digital content supplied without a physical medium when performance has begun after:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">the Client\u2019s prior express agreement for immediate access to the service;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">the Client\u2019s express acknowledgement of the loss of their right of withdrawal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When placing the order, the Client is invited to tick a box confirming:<br>\u201cI accept the immediate performance of the service and waive my right of withdrawal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, no refund may be requested after payment has been validated and access has been made available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>9. Support, assistance and complaints<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of difficulty (access not received, bug, unavailability, payment issue), the Client should contact support:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Email: examplatform@klf.fr<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Telephone: +33 9 53 03 16 20<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Newdeal Institut makes every effort to process requests within a reasonable time, with priority given on working days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>10. Availability and maintenance (best-efforts obligation)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Newdeal Institut uses its best efforts to make the Platform accessible 24 hours a day, 7 days a week, subject to maintenance (preventive, corrective or upgrade-related) and possible technical incidents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Newdeal Institut does not guarantee continuous and uninterrupted availability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>11. Liability<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Newdeal Institut implements all reasonable means to ensure access to and proper functioning of the Platform, without guaranteeing the absence of technical interruptions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the Platform is a training tool, Newdeal Institut does not guarantee exam results and cannot be held liable in the event of failure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Newdeal Institut cannot be held liable for indirect damage resulting from the use of the Platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In any event, should its liability be established, compensation shall be limited to the amount actually paid for the Module concerned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>12. Intellectual property<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The content (questions, databases, texts, resources, brand and interface) is protected and remains the property of KLF \/ Newdeal Institut or their rights holders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any reproduction, copying, extraction, distribution, resale or making available to third parties, in whole or in part, is prohibited without express authorisation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>13. Personal data protection (GDPR)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The data collected during registration, purchase and use of the Platform is processed in accordance with the applicable regulations and the privacy policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Data that may be collected: title\/gender, surname, first name, date of birth, telephone number, nationality, email address, training\/progress history.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payment data is processed by Stripe. Order and tracking data may be stored in Fidelo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hosting: Kinsta<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subcontractors: Stripe, Fidelo<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Privacy policy: https:\/\/klf-examen.fr\/privacy-policy\/<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Retention periods<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201caccount &amp; activity\u201d data: 3 years from the last contact\/last activity;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">accounting data: 10 years in accordance with legal obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Client has the right to access, rectify, erase, restrict, object to and port their data, in accordance with the GDPR, by contacting examplatform@klf.fr.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>14. Force majeure<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Newdeal Institut may not be held liable in the event of partial or total non-performance of its obligations due to an event of force majeure as defined by French case law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>15. Applicable law and jurisdiction<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These TCS are governed by French law. In the event of a dispute, the competent courts shall be those within the jurisdiction of the registered office of Newdeal Institut (Bordeaux), unless otherwise required by mandatory provisions applicable to consumers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>16. Modification of the TCS<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Newdeal Institut reserves the right to modify these TCS.
